There are 2 ways: administrative and judicial. In the first case, a complaint is filed with the higher authority of the tax service. But in practice, the tax service rarely cancels the decisions of its own inspectors. Most often, everything has to be appealed in court. However, both ways do not exclude each other. You can use both ways.
If it is an administrative way, then you have 10 working days from the moment of receiving the tax notice decision to file a complaint. If you have already filed a complaint, then to go to court you have 1 month from the moment the tax service makes a decision on your complaint. If you decided to go directly to court (without filing a complaint with the tax service), you have 6 months.
Yes, if it is possible to prove part of the operations, the tax notice decision is adjusted, and additional charges are reduced.
After it comes into force, it is subject to compulsory enforcement. Taxes and fines will be collected through the tax service or the enforcement service. Tax invoices may also be blocked and accounts may be seized.
It all depends on the specific case. But overall the chances are quite good. Courts often side with taxpayers if they present the right arguments. In particular, there are often cases when the tax authority did not really understand the situation and added taxes hoping that the taxpayer would simply agree and pay these amounts. Therefore, it is definitely worth fighting for your rights and money.
