What is tax residency?
This status determines where exactly you must declare your income and pay taxes. For example, most Ukrainian citizens are tax residents of Ukraine, as this is where they earn their income and pay taxes. Foreigners (non-residents of Ukraine) must pay taxes in Ukraine only if they received their income here.
How can I determine if I am a resident of Ukraine?
The Tax Code of Ukraine sets out several criteria. Residents are generally defined as those who permanently reside in Ukraine (more than 183 days a year), have their center of vital interests in Ukraine (family, property, sources of income), and hold Ukrainian citizenship.
Can I be a resident of two or more countries at the same time?
Yes, if you meet the criteria for tax residency in multiple countries simultaneously. In this case, you are required to pay taxes and declare income in multiple countries. In such cases, our specialists can help determine how to legally avoid double taxation.
What is double taxation?
This is a situation where the same income (or property) is taxed simultaneously in different countries. To do this, you must sever ties with Ukraine: move abroad, stop returning to Ukraine, and dispose of your property and business here. And all of this will need to be documented and supported by documentation.
What documents can confirm my status?
It depends on the situation. For example, in Ukraine, you can obtain a certificate of tax residency in Ukraine. Tax returns and other documents can also serve as proof.
How exactly can double taxation be avoided?
It depends on the applicable double taxation agreement and the mechanisms it provides. For example, you may be completely exempt from income taxation (on certain types of income) in one country. Or, taxes paid in one country may be offset against tax liabilities in another.
With which countries does Ukraine have double taxation agreements?
By 2025, Ukraine has concluded 72 bilateral agreements. In particular, with Poland, Austria, Denmark, the Netherlands, Great Britain, Switzerland, Singapore, the UAE, Qatar, Malaysia, and Canada. From August 1, 2025, such an agreement between Ukraine and Japan will also enter into force.
